In order to implement the deployment requirements of Document No. 1 of the Central Committee in 2023, better safeguard and realize the rights and interests of farmers in contracted management, promote the optimal allocation of land resources, and improve the efficiency of cultivated land use, the following opinions are put forward on the relevant work to solve the contracted land fragmentation pilot.
I. General requirements
We will explore ways to solve the fragmentation of contracted land and further consolidate and improve the basic rural management system.
Local organizations should carry out trials to resolve the fragmentation of contracted land, adhere to the collective ownership of rural land by farmers, give full play to the functions and roles of rural collective economic organizations in coordinating and providing services, rationally distribute profits, properly resolve problems, and guard against business risks. We must uphold the basic position of rural households in contracted operations, respect the will of farmers, fully mobilize their enthusiasm and initiative, give them the right to choose, strengthen demonstration and guidance, do not force promotion, and must not undermine farmers' rights and interests. We must adhere to the strictest system of protecting arable land, and must not change the use of land or destroy the overall agricultural production capacity.
Second, do a good job of pilot organizations
1. Scientifically selecting the scope of the pilot program. Taking into account factors such as topography, irrigation conditions, and crop varieties, priority will be given to pilot projects in plain and shallow hill areas with high public willingness, strong grass-roots organizations, and solid work in determining, registering, and certifies contracted land. A village group that intends to carry out a pilot project shall, in accordance with the law, obtain the consent of more than two-thirds of the members of the villagers' meeting of the members of the collective economic organization or more than two-thirds of the villagers' representatives before organizing to carry out the pilot project.
2. Exploring paths in light of local conditions. To adopt the "contracting right does not move, the right to operate in a row" approach to solve the fragmentation of contracted land, with low risk, low cost, easy operation, can be traced back and other advantages, encourage all localities to adopt this approach combined with farmland construction, land improvement and other projects to organize implementation. For the majority of farmers are still directly farming contracted land, we can explore the centralized management rights of farmers contracted land, realize the continuous operation of households, and solve the problems such as farming inconvenience. For those who have already transferred most of the rural labor force to the secondary and tertiary industries, we can explore ways to set up self-planting areas in which contracted farmers operate on contiguously owned plots and lease areas in which new agricultural operators concentrate on contiguously owned plots, so as to meet the diversified needs of different entities to solve the fragmentation of contracted land. It is necessary to formulate pilot programs according to the actual conditions of village groups, and clarify objectives and tasks, implementation paths, schedule and safeguard measures.
(3) Standardizing procedures for the performance of work. The pilot areas should do a good job of investigation, publicity and mobilization, plan formulation, democratic resolution, organization and implementation, summary and acceptance, etc., to ensure that the pilot tasks are completed in a standardized and orderly manner. It is necessary to ensure the compliance of procedures and the approval of farmers, so that the policy is interpreted to the household, the will is consulted to the household, the information is verified to the household, and the signature is confirmed to the household. It is necessary to strengthen archive management, and the implementation plan, plot diagram, farmers' signature confirmation record, circulation contract and other information formed in the work should be strictly archived and managed to provide support for protecting farmers' rights and interests.
4. Strengthening information technology support. Make full use of the results of the confirmation, registration and certification of rural contracted land, provide information technology support for the pilot project to solve the fragmentation of contracted land, explore the establishment of a mechanism of "mapping land, mapping land management", and achieve clear and verifiable information on the management rights of contracted land. After breaking the boundary of ridges and land concentration, it is necessary to ensure that the spatial location and area of the contracted land can be traced back according to the ownership confirmation data, so as to ensure that farmers' land contract rights and interests are not damaged.
(5) Timely summary and acceptance. Summarize the pilot experience in a timely manner, form institutional results, and do a good job of transformation and promotion. We should conscientiously carry out visits and investigations to find out whether the rural masses are satisfied and benefited from the pilot work.
Third, strictly implement policy requirements
1. Maintaining the stability of land contract relations. We will implement the central government's policy requirements on maintaining stable and permanent land contract relations, and resolutely prevent the use of fragmented land contracted by rural households to disrupt and redivide land. For farmers who voluntarily exchange land contract management rights to solve the fragmentation of contracted land, it is necessary to sign a written contract in strict accordance with relevant laws and regulations, submit it to the employer for record, and change the rural land contract in a timely manner.
2. Distribute income in a scientific and rational way. The additional cultivated land and income from the settlement of the fragmentation of contracted land shall be strictly managed, and the members of rural collective economic organizations shall independently adjust the interest relationship through democratic consultation in accordance with the law and regulations, so as to achieve reasonable distribution and standardized use.
(3) Standardize the transfer of land. After the land is centralized and connected, if the external circulation is unified, there should be a written power of attorney from the farmers, and it should be guided to carry out openly through the rural property rights circulation and trading market. For industrial and commercial enterprises and other social capital through the transfer of land management rights, to strictly implement the qualification examination, project review and risk prevention system.
Fourth, effectively strengthen job security
1. Strengthen organizational leadership. The agricultural and rural departments of provinces, autonomous regions and municipalities directly under the Central Government should take the lead in establishing and improving the coordination and promotion mechanism, effectively strengthen the guidance for solving the pilot work of contracted land fragmentation, formulate specific measures based on actual research, and organize and carry out the pilot.
2. Strengthening policy support. In order to effectively exert the effect of policy integration, provincial agricultural and rural departments can, according to the actual situation, incorporate qualified pilot areas into the scope of support for land consolidation, high-standard farmland construction and other projects.
3. Strengthening risk prevention and control. It is necessary to study and judge in a timely manner the problems and contradictions that may arise during the pilot process, make good risk prevention and control plans, properly solve the problems of concern to the farmers, and maintain social stability and tranquility in rural areas.
The agricultural and rural departments of all provinces, autonomous regions and municipalities directly under the Central Government shall report the pilot progress to the Ministry of Agriculture and Rural Affairs by the end of December each year, and timely report major matters.
